What Is Mediation?
Mediation is a form of alternative dispute resolution (ADR) that involves the parties working with a neutral third-party mediator to come to terms.
The mediator is not a judge—he or she does not make any decisions on behalf of the parties.
The mediator’s role is to:
- Help the parties work together to understand each other’s positions,
- Help them see when they may need to be willing to compromise, and
- Help them reach an agreement that ultimately serves both of their best interests.
The mediator you choose should be experienced in family law matters. You need a mediator who is knowledgeable about the issues involved in your case and who can help you and your family member explore creative and valid solutions to resolve your differences.
The Florida Supreme Court certifies family law mediators, and a Certified Family Mediator is often the best choice for matters such as:
- Time-sharing and parental responsibility issues (custody issues)
- Child support
- Alimony
- Division of marital and separate property in a divorce
Certified Family Mediator
Attorney Sonica Cinami is a Florida Supreme Court-Certified Family Mediator. By serving as a mediator, Ms. Cinami has had the opportunity to listen to both sides in family law matters, considering each side’s arguments from an impartial point of view. This experience provides valuable insights when representing clients in arbitration and mediation.
While mediation inherently involves an element of compromise, it is still critically important for individuals to protect their interests during the process. Mediation in family law matters should be a win-win proposition. Being able to anticipate other parties’ positions helps us make sure that our clients get what they want out of the process.
Attorneys for Family Law Mediation in Orlando
In mediation, both parties are represented by their own attorneys. Similar to the collaborative law process, the attorneys’ role is to help the parties protect themselves while also fostering a commitment to their chosen method of resolution. In divorces and other family law matters, disagreements are inevitable. But, experienced mediation attorneys should be able to help the parties remain civil while continuing to work toward a mutually-agreeable outcome.
We are often asked if the parties can each be represented by the same attorney. While the thought is usually that this will save money and avoid contentious disputes that end up in court, the reality is that it is in both parties’ best interests to each have their own legal counsel.
There are actually a number of reasons why:
- First, you are very likely to have thoughts and information that you want to keep confidential.
- You are also very likely to want legal advice focused on what is best for you—and this is critical to reaching appropriate compromises in mediation.
By hiring your own attorney, you can preserve your confidentiality, and you can avoid the conflicts of interest that arise when parties on opposite sides have the same legal representation.
